  1. Terms and Conditions
    This page states the terms and conditions under which you may access and use the www.306RealEstate.com Web Site (the "Web Site"). Please read these provisions carefully. If you do not agree with the following provisions, you should immediately exit the Web Site and discontinue any use of its services. By using the Web Site, you are indicating your acceptance to be bound by this User Agreement. 306RealEstate.com ("306 RealEstate.com" or the "Company") reserves the right to amend this User Agreement from time to time. The terms "You", "Your" and "User" are used in this document to refer to all individuals and/or entities accessing this Web Site.

    306RealEstate.com does not warrant or make any representations or claims as to the quality, accuracy, currency or otherwise of any information contained on our Web Site or any Web Sites linked to it. Any decision or action taken based on information contained in our Web Site or any Web Sites linked to it are the sole responsibility of the user. The Company will not be liable for any claim or damage arising out of interpretation, reliance upon or other use of the information.

  2. Using 306RealEstate.com
    While using our Web Site, you will not:
    • violate any laws, third party rights, or our policies;
    • use the Web Site materials, products or services to violate any law;
    • use our Web Site other than in accordance with our policies, as reflected in this User Agreement;
    • use our email Connect system for any unauthorized or commercial purpose, except those specifically permitted by us;
    • use the Web Site if you are not able to form legally binding contracts or are under the age of 18
    • post false, inaccurate, misleading, defamatory, or libelous content;
    • distribute or post spam, chain letters, or pyramid schemes;
    • distribute viruses or any other technologies that may harm 306RealEstate.com, or the interests or property of 306RealEstate.com users;
    • copy, modify, or distribute content from the Web Site and 306RealEstate.com's copyrights and trademarks; or
    • harvest or otherwise collect information about our customers, users, or affiliates, including email addresses, without their consent.
  3. Liability
    You will not hold 306RealEstate.com responsible for other users' actions or inactions. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, merchantability or safety of the property advertised, the truth or accuracy of listings, the ability of sellers to sell property, or that a seller will actually complete a property transaction.

    Notwithstanding the previous paragraph, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you have paid to us or our affiliates in the 12 months prior to the action giving rise to the liability, and (b) $100.

  4. Copyright
    All information and materials displayed or otherwise accessible through this Web Site are protected by copyright law, and are owned by 306RealEstate.com or the party accredited as the provider of the Content. Except as granted in the limited license set out in this User Agreement, any use of the Content, including modification, transmission, presentation, distribution, republication, or other exploitation of our Web Site or of the information, materials or content on our Web Site is prohibited without the express prior written consent of 306RealEstate.com.
  5. Limited License
    The Company authorizes you to view and download a single copy of the material on 306RealEstate.com solely for your personal, non-commercial, or educational purposes, provided that:
    • you do not modify any such content; and
    • you include with and display on each copy of such content the associated copyright notice and this limited licence.
    • Without limiting the generality of the foregoing, you may not:
      • make any commercial use of such content;
      • include such content in or with any product that you create or distribute; or copy such content onto your or any other web-Web Site.
  6. Content License
    When you provide us content, including listing information, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to exercise the copyright, publicity, and database rights that you may have in the content. (We need these rights to host and display your content.)
  7. Links
    The Web Site contains links to third-party web sites. These links are provided solely as a convenience to you and not as an endorsement by us of the contents of such third-party Web Sites. 306RealEstate.com is not responsible for the content of any third-party Web Site, nor does it make any representation or warranty of any kind regarding any third-party Web Site.
  8. Indemnity
    You will indemnify and hold us (and our officers, directors, agents, subsidiaries, affiliates and employees), harmless from any claim or demand, including legal fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
